The appeals court has granted the motion filed by lawyers of former Justice Minister Oleksandr Lavrynovych, charged with conducting activities aimed at forcible change of constitutional system, to release him from custody.

Censor.NET correspondent reported from the court room yesterday, Sept. 27.

Supporters of Lavrynovych greeted the court's decision with applause.

"There are judges in Ukraine who are brave enough to make fair decisions," Lavrynovych said.

The court has rejected the motion filed by the Prosecutor General's Office (PGO) to choose custody as a restraint measure. The article of the Criminal Code of Ukraine that covers the charges Lavrynovych is facing does not provide for any other measure of restraint than custody.

This means that Lavrynovych ended up at large without any measure of restraint against him.

On Sept. 15, the Pecherskyi
district court granted the request of the prosecutor's office and chose a restraint measure of 60 days arrest without a bail option for former Justice Minister of Yanukovych period Oleksandr Lavrynovych. Lavrynovych is charged with conducting activities aimed at forcible change of constitutional system, which stipulates for five to 10 years in prison.

On Sept. 6, Prosecutor General Yurii Lutsenko said PGO served indictment to former President Viktor Yanukovych and former Justice Minister Oleksandr Lavrynovych for power grab through illegal return to Constitution of 1996 in 2010.

Former minister commented on this information by saying he did not consider his actions a crime and was just doing his job in 2010.

In 2004, the Verkhovna Rada adopted amendments to the Constitution, as a result of which Ukraine shifted from presidential-parliamentary to parliamentary-presidential republic. In 2010, the Constitutional Court of Ukraine returned the country to the presidential-parliamentary form of government, returning part of the authority to the president lost after the 2004 constitutional reform.
