"NABU has never requested the prosecutor general to bring SAP head to justice as it was announced by Yuri Lutsenko on air of a TV channel. He was most likely talking about the complaint filed by the Bureau detectives in response to SAP chief's inaction in the investigation of the so-called UIA (Ukrainian International Airlines) case in accordance with Ukraine's procedural law," the agency said.
"We are particularly talking about the notice of suspicion drafted by the NABU detectives Nov. 10, 2016 in accordance with Article 277 of the Criminal Procedure Code of Ukraine submitted for approval by the SAP head. The detectives requested a consent to announce suspicion to CEO and accountant-general of Ukrainian International Airlines JSC and the former head of the State Aviation Administration of Ukraine. These individuals were suspected of a large-scale embezzlement of funds designated for covering nationwide aircraft operating expenses and Ukraine's participation in international aviation organizations. The offense is covered by part 5 of article 191 of the Criminal Code of Ukraine.
"NABU obtained a waiver to serve the aforementioned notice of suspicion signed by Kholodnytskyi Nov. 24. Having scrutinized the letter, the agency detectives came to the conclusion that the findings and judgments contradicted the submitted information confirmed by the collected evidence. That is why the agency lodged negligence complaint to the prosecutor general against his deputy, the SAP head, under the law (Articles 311,312 of the Criminal Procedure Code of Ukraine) Nov. 25," NABU said.
"We emphasize that the procedure for submitting complaints against inaction of prosecutors is clearly defined by provisions of the Criminal Procedure Code of Ukraine, according to which the complaint is lodged to a prosecutor with a higher rank then the one of the prosecutor whose decision, action or inaction is appealed.
"Given that the decision not to authorize serving suspicion was made by the deputy prosecutor general of Ukraine - head of the Special Anti-Corruption Prosecutor's Office, the complaint against his inaction was lodged to the prosecutor general, as prescribed by the established procedure.
"However, the prosecutor general, instead of seeing into the matter and taking measures, as required by law, made a public statement that might harm interaction between NABU and SAP," the agency stressed and posted the complaint in question.
