As reported by Censor.NET, the Commercial Court of the Odesa region has recognized Empson Limited and Phonrun Operation Limited as the Odesa Port Plant lenders with total amount of claims exceeding 14 billion hryvnia (up to $540 million). The decision was based solely on statistical reports submitted by the alleged lenders.
The ruling of the Commercial Court of the Odesa region of Aug. 8, 2016 established monetary claims filed by Empson Limited (Cyprus) in the amount of 14,307,805,860.18 hryvnia and Phonrun Operation Limited (Cyprus) amounting to 47,259,220.12 hryvnia.
Servis-Spetstekh-Pivden LLC disagreed with the ruling and challenged it in the Appeals Court.
The legal analysis of the case files makes it possible to assert that there is no hard evidence of the Odesa Port Plant's debt to these companies.
Empson Limited and Phonrun Operation Limited are known to be owned by ill-famed fugitive oligarch Serhii Kurchenko. He acquired 99.6 percent of the shares in the Odesa Port Plant JSC during Yanukovych's tenure as a president of Ukraine.
Servis-Spetstekh-Pivden LLC filed a petition to carry out forensic audit of the enterprise in order to provide hard evidence in the case. One of the Justice Ministry's scientific research institutes of judicial investigation was directed to conduct this expert examination.
There are reasons to suspect that Serhii Kurchenko may intervene in the litigation using his relations with corrupt judges in order to uphold the decision of the Commercial Court of the Odesa region. The previous court sitting to consider the petition scheduled for Oct. 5 did not take place.
Several Ukrainian MPs have filed requests to the Prosecutor General's Office, the Security Service and the State Fiscal Service of Ukraine regarding the Odesa Port Plant JSC.
