 Ukraine’s High Specialized Court quashes unlawful judgment of Solomianskyi court in Ivaniushchenko’s case, - PGO

High Specialized Court of Ukraine for Civil and Criminal Cases has quashed the decision of the Solomianskyi district court of Kyiv obliging the Prosecutor General's Office (PGO) to cease the criminal proceedings filed against former Verkhovna Rada Deputy (Party of Regions) Yurii Ivaniushchenko, also known as Yura Yenakievskyi.

"The Prosecutor General's Office Directorate in charge of procedural control over criminal proceedings filed by members of Special Investigation Department appealed on cassation of the unlawful decision of the Kyiv Appeals Court of Feb 11, 2016, denying review of the judgment made by the investigating judge of the Solomianskyi district court of Kyiv in the criminal proceedings against Yurii Ivaniushchenko,"the statement reads.

"The mentioned judgment of the investigative judge held the authorized prosecutor to cease the criminal proceedings against Yuri Ivaniushchenko in violation of the procedural legislation of Ukraine," the PGO noted.

The decision of the High Specialized Court of Ukraine for Civil and Criminal Cases of June 9, 2016 granted the prosecutor's cassation appeal and quashed the judgment of the Kyiv Appeals Court of Feb 11, 2016 as unlawful.

The Prosecutor General's Office of Ukraine intends to take further measures to intensify the pretrial investigation in the abovementioned criminal proceedings and appeal against unlawful court decisions.
