 Case against Yurii Ivaniushchenko on Kyoto funds embezzlement closed through deputy prosecutor general’s inaction, - Nashі Hroshі project

The court ruled the deputy prosecutor general to dismiss the criminal case filed against Yurii Ivaniushchenko for embezzlement of public funds received by Ukraine from Japan for greenhouse gas emissions quotas under the Kyoto Protocol.

This is evidenced by the decision of Solomianskyi district court in Kyiv of Jan. 27, 2016, Censor.NET reports citing Nashі Hroshі project.

Deputy Prosecutor General Yurii Stoliarchuk had to make the decision to dismiss the case No. 42015000000000207 within three days from the date of ruling. The court's decision was not subject to any appeal.

Under this criminal proceedings, Ivaniushchenko was suspected of embezzlement of 72 million Swiss Francs, which is 1.88 billion hryvnia according to central bank exchange rate, as well as embezzlement of public funds in the amount of 170 million hryvnia received by Ukraine from Japan for greenhouse gas emissions quotas under the Kyoto Protocol.

The court has made the decision under the complaint filed by Ivaniushchenko's lawyer Yurii Kolesnikov regarding deputy prosecutor general's inaction in the investigation of the criminal case.

The lawyer insisted that the term of pre-trial investigation into Ivaniushchenko expired while there were no decisions made on its extension. The pre-trial investigation term for grave crimes is one year from the date when notice of suspicion was served. Ivaniushchenko was served notice of suspicion Dec. 29, 2014.
