 Cabinet proposes Rada to dismiss the head of the Ministry of Ecology Ihor Shevchenko

The government of Ukraine at its meeting on June 24 decided to submit a motion to the Verkhovna Rada on dismissal of Ihor Shevchenko appointed to the post on the quota of the parliamentary faction of the political party "The All-Ukrainian Union Batkivshchyna" from the position of the Minister of Ecology and Natural Resources of Ukraine for committing acts which could show signs of corruption or violations of the requirements to the behavior of the persons authorized to perform state functions.

This decision was taken due to the fact that the Ministry of Natural Resources as the central body of executive power has lost control. It does not ensure execution of the basic functions and obligations of the state in the field of environmental protection, Censor.NET reports citing the press service of the Cabinet.

"The members of the government proposed Ihor Shevchenko to resign voluntarily during the meeting of the Cabinet of Ministers but he refused," the statement reads.

According to the motion, Ihor Shevchenko was appointed the Minister of Ecology and Natural Resources of Ukraine by the resolution of the Verkhovna Rada of Ukraine on December 2, 2014 "on the formation of the Cabinet of Ministers of Ukraine" on the quota of the parliamentary faction of the political party "The All-Ukrainian Union Batkivshchyna".

"The violations of law had repeatedly been committed during Ihor Shevchenko's tenure as minister in consequence to which the checks were conducted and confirmation of the relevant facts was received. In particular, Ihor Shevchenko travelled to the United Arab Emirates on personal issues during working time without a permit in January 2015. The minister was also absent at the workplace without a valid reason and unreasonably failed to take part in a meeting of the Government May 5, 2015. In addition, Ihor Shevchenko departed to Dresden on a charter flight by a TSTKN private plane on personal issues June 6, 2015 at 2.30 p.m. and returned from Nice using PHARO private jet June 8, 2015 at 4 p.m. (during working time)," the document reads.

"Along with these facts the "privatization" of the Ministry by the gas tycoon, MP Oleksandr Onyshchenko took place. In particular, Ihor Shevchenko during his tenure as Minister of Ecology and Natural Resources of Ukraine made a motion on the appointment of P. Matvieiev to the post of the Chairman of the State Service of Geology and Mineral Resources, who was Oleksandr Onyshchenko's authorized representative during the parliamentary elections in 2012, as well as organized the work of "Nadra Geocenter Ltd." "Plast PJSC" and other enterprises owned by Oleksandr Onyshchenko," the motion reads.

Besides, according to the information confirmed by the Minister of Ecology and Natural Resources during a meeting of the Government on June 17, 2015 Oleksandr Onyshchenko contributed to Ihor Shevchenko's flights abroad by private aircrafts. The Minister has also confirmed his close relationship with Oleksandr Onyshchenko during ten years.

"These facts reveal a violation of the requirements of Articles 22 and 23 of the Law of Ukraine "on prevention of corruption", according to which the Minister may not use his power or his office and the related opportunities in order to obtain undue advantage for himself or other persons and which prohibits to receive gifts for himself or his relatives directly or through other persons from legal entities or private persons," the motion reads.

In addition, according to the document, Ihor Shevchenko during his tenure has not provided timely, high-quality and comprehensive implementation of tasks relevant for the reform of the sector, which were provided by a number of legal acts including the Program of Activities of the Cabinet of Ministers of Ukraine, the Coalition Agreement, the Action Plan of the Implementation of the Program of the Cabinet of Ministers of Ukraine and the Sustainable Development Strategy "Ukraine - 2020" in 2015, the National Action Plan for the Environment Protection for 2011-2015.

In particular, the Ministry has not carried out the work associated with the preparation and submission to the Government of the crucial draft legislative acts aimed at but not limited to the implementation of the requirements of the Association Agreement with the EU (Appendix XXX), which would have contributed to the rapid reform of waste management. The introduction of transparent, fast mechanisms of issuing permits in the field of the environmental protection was not implemented, the system of state supervision (control) in this field was also crippled, control over the environment in Ukraine as a whole and in separate regions was lost.

"As a consequence, the number of environmental emergencies, which could and should be prevented under the conditions of professional governance, has increased greatly," the motion reads.

For six months of his work, the minister has not provided targeted and efficient use of funds received within sector budget support of the EU aimed at the implementation of activities under the National Action Plan on Environmental Protection for 2011-2015.

"Taking the foregoing into consideration, given that the Ministry of Natural Resources as the central body of executive power has lost control, it does not provide implementation of the basic functions and obligations of the state in the sphere of the environmental protection and in accordance with Paragraph 2 of the Item 1 of the Article 18, Paragraph 4 of the Article 45 of the Law of Ukraine "on the Cabinet of Ministers of Ukraine" I bring the proposal on resignation of Ihor Shevchenko, appointed to the post on the quota of the parliamentary faction of the political party "The All-Ukrainian Union Batkivshchyna" from the position of the Minister of Ecology and Natural Resources of Ukraine for committing acts which could show signs of corruption or violations of the requirements to the behavior of the persons authorized to perform state functions," the motion reads.
