According to the report, the applicant's demands are as follows:
First, to recognize that the rights and liabilities of Naftohaz of Ukraine on the transit contract for 2009-2019 are to be transferred to Ukrtranshaz PJSC.
Second, to recognize that certain provisions of the contract, which will be subsequently specified, are invalid and/or void and must be amended or replaced by provisions which will be specified later, in accordance with the energy and anti-monopoly legislation of Ukraine and the European Union.
Third, to oblige Gazprom to pay Naftohaz the compensation in the amount of $3.2 billion, as well as interest on that amount for gas transit volumes undersupply.
Fourth, to recognize that transit tariff in the contract shall be amended according to the rationalization, which will be submitted by Naftohaz of Ukraine later in accordance with the basic principles of the Swedish contract law.
"The provisional amount of claims is $6.2 billion. Gazprom replied the arbitration request Nov. 28. The arbitral panel was drawn Dec. 11," Gazprom noted.
