 SAP chief vows to stop cooperating in investigation until its jurisdiction clearly defined

Advocating for the impartiality of the investigation, Head of the Specialized Anti-Corruption Prosecutor's Office (SAP) Nazar Kholodnytskyi insists on the review of the investigative jurisdiction in his case as part of which he was wiretapped.

As reported by Censor.NET citing Interfax-Ukraine, Kholodnytskyi said after giving testimony at the Major Frauds Investigations Department of the Prosecutor General's Office of Ukraine on Tuesday, April 3.

"They tried to take samples of my voice as part of the investigation, but I believe them to be biased, since the department head is a suspect in three probes being developed by SAP and NABU. I have little recourse to impartiality of the investigation, so I expect a decision to replace the investigators and prosecutors of the department involved in this case," he said.

"As long as the investigative jurisdiction is clearly defined, I will not cooperate in the investigation," he added.

Ukraine’s top anti-corruption prosecutor, however, assured that he is "ready to give the testimony, ready to argue my position" with or without defense.

The covert investigation against Kholodnytskyi was launched under article 368 of Ukraine’s Criminal Code – receipt of a bribe by a state official. "That is, I apparently extorted a bribe from some person, but I have no idea who might that person be while they tell me no details."

Elaborating on the facts of the case in which he gave testimony, Kholodnytskyi said: "I am suspected of committing two offenses: coercion to testify – an "interesting" interpretation... and disclosure of findings of the pre-trial investigation. I only wonder how a prosecutor - a supervisor of pre-trial proceedings - could actually do this if he is the one who both collects and stores this data."

On March 30, Prosecutor General Yurii Lutsenko initiated dismissal of Kholodnytskyi over alleged disciplinary offenses.

Several news agencies earlier reported that Kholodnytskyi considered his resignation over alleged health issues. According to another opinion, possible resignation of SAP’s chief can be connected to the pressure exerted on him. Kholodnytskyi later said he had no intent to resign.
