 Cabinet of Ministers Proposes to Introduce Late Fees for Utility Bills

Ministry of Regional Development, Construction and Housing proposes to charge late fees at the rate of 0.1% of the amount of debt for each day of delay in payment for utility services.

The text of the bill "On Amending Article 32 of the Law of Ukraine "On Housing and Communal Services" on the accrual of penalties for late payment for housing and communal services" is published on the official website of the Ministry of Regional Development.

It is proposed to establish that in the case of late payment for utility services the customer is obliged to pay a fine of 0.1% of the outstanding balance, which is calculated for each day of delay, but not more than 100% of the debt. Accrual of interest will begin on the day following the last day of the deadline for payment for housing and communal services. The deadline for payment for utility services is the 20 day of the month following the reporting.

At that the bill provides that the procedure for calculation and collection of fines is approved by the central executive bodies which form and ensure the implementation of state policy in the sphere of housing and communal services and energy.

"The purpose of the bill is to settle the legal issues the matter of penalty for late payment of fees for municipal services and the conditions for its assessment and collection," says the memorandum to the bill.

The moratorium on late fees for utility debt was in effect since 1996 and expired in January last year, but the amount of late charges has not yet been determined in legislation.

Also worth noting is the fact that a similar initiative has been voiced by the Ministry of Regional Development in 2012 but the government has not considered this issue.
