 Cabinet of Ministers Proposes to Introduce Late Fees for Utility Bills

Ministry of Regional Development, Construction and Housing proposes to charge late fees at the rate of 0.1% of the amount of debt for each day of delay in payment for utility services.

Thetext of the bill "On Amending Article 32 of the Law of Ukraine "OnHousing and Communal Services" on the accrual of penalties for latepayment for housing and communal services" is published on theofficial website of the Ministry of RegionalDevelopment.

It is proposed to establish that in the case oflate payment for utility services the customer is obliged to pay afine of 0.1% of the outstanding balance, which is calculated foreach day of delay, but not more than 100% of the debt. Accrual ofinterest will begin on the day following the last day of thedeadline for payment for housing and communal services. Thedeadline for payment for utility services is the 20 day of themonth following the reporting.

At that the bill provides that the procedure forcalculation and collection of fines is approved by the centralexecutive bodies which form and ensure the implementation of statepolicy in the sphere of housing and communal services andenergy.

"The purpose of the bill is to settle the legalissues the matter of penalty for late payment of fees for municipalservices and the conditions for its assessment and collection,"says the memorandum to the bill.

The moratorium on late fees for utility debt wasin effect since 1996 and expired in January last year, but theamount of late charges has not yet been determined inlegislation.

Also worth noting is the fact that a similarinitiative has been voiced by the Ministry of Regional Developmentin 2012 but the government has not considered thisissue.
