As reported by a correspondent for Censor.NET, this was said by lawyer of victim families Vitalii Pohosian.
According to him, the court dismissed the motion of the Military Prosecutor's Office to recover 28.7 million hryvnia (over $1.06 million) from senior military official who was found guilty of the death of the Ukrainian military killed after an Il-76 transport plane was shot down in Luhansk in 2014.
"The court dismissed it since there should be a different procedure. It is the Ministry of Defense that should sue Nazarov. Today, the court obliged the Defense Ministry to pay the relatives of the deceased a compensation for moral damage. The amount of about 20 million hryvnia is meant. The Ministry of Defense also has the opportunity to recover 28 million from Nazarov. I do not know why the ministry has not filed a lawsuit," Pohosian said.
The lawyer added that the relatives of the deceased servicemen were satisfied with the court ruling and would prepare for Nazarov's appeal.
On June 14, 2014, Ukraine's Il-76 with 40 troopers and nine members of the crew was shot down during landing in the Luhansk airport. All people on board were killed.
Dec. 17, 2015, the Pavlohrad city district court of the Dnipropetrovsk region started a trial into the Il-76 case.
On March 27, 2017, the Pavlohrad city district court sentenced Nazarov to seven years in prison under article 425 of the Criminal Code of Ukraine. He was not deprived of the rank of major general. The moral damage suffered by the families of the victims is to be compensated by the Ministry of Defense. However, only the closest relatives - parents and wives - will receive a compensation.
The amount of compensation is 500,000 hryvnia ($18,367) for each family.
The court recognized inactivity and official negligence in Nazarov's actions. The evidence of the prosecution, according to the court, was fully proven. The court has taken into account the lack of a criminal record and a positive service record of the defendant.
